Terms of Service
Last updated: 26 October 2026 (draft)
These terms govern the use of Iseka Loyalty ("the Service", "we", "us") by a business ("the Merchant", "you"). The Service lets a Merchant run a digital stamp-card loyalty programme: customers join via a QR code or link, staff add stamps by scanning, and customers earn rewards the Merchant defines.
1. Who we are
The Service is provided by Yeskendir Zharimbet, trading as Iseka Loyalty (a sole trader — Iseka Loyalty is a trading name, not a separate legal entity or registered company). Service address for legal notices: Discovery, 50 Waterline Way, London, SE8 3NB, United Kingdom. Contact: isekaagency@gmail.com.
2. The Service
- Digital loyalty cards that customers open in a browser — no app download required.
- A staff scanner for adding stamps and redeeming rewards.
- An owner dashboard with customer, activity and programme management.
- Optional Apple Wallet passes for customers, updated when stamps change.
Features described as in testing or preview are provided as-is and may change. We do not promise features that are not yet built.
3. Subscription and payment
- The Service costs £29 per month per business, billed monthly in advance.
- There is no free trial and no setup fee. You can cancel at any time.
- Cancellation takes effect at the end of the current paid month — you keep access until then, and we do not refund partial months except where the law requires it.
- The Service is sold to businesses. Consumer cancellation rights (such as the 14-day cooling-off period) do not apply to purchases made wholly or mainly for business purposes.
- Payments are processed by Stripe. Your card details go directly to Stripe; we never see or store them.
- If a payment fails, we may pause new sign-ups and stamping until the payment succeeds. Rewards customers have already earned remain redeemable.
- The provider is not currently registered for VAT, so no VAT is charged on the £29 monthly price at present — £29 is the total you pay. This is not a claim of exemption from VAT: if VAT registration becomes required or is chosen in future, or tax rules change, we will update pricing or invoices and notify you before any change takes effect.
4. Your responsibilities as a Merchant
- You decide your programme's rules (stamps required, rewards, sign-up questions) and must honour the rewards your customers earn. We provide the tool; the promise to the customer is yours.
- You must use the Service lawfully, including consumer-protection and data-protection law in your dealings with customers.
- You are the data controller for your customers' loyalty data. Our Data Processing Agreement is intended to form part of the approved terms and govern how we process that data for you; these drafts are not yet incorporated.
- Keep your account credentials and staff invitations secure. You are responsible for actions taken through your account.
- Do not collect sensitive personal data (for example health data) through the sign-up form, and do not use the Service to send marketing without the customer's own consent.
5. Customers
Customers join a Merchant's programme free of charge and are not party to these terms. Each customer's relationship is with the Merchant whose programme they join. Customers can delete their card link at any time and can ask the Merchant to remove their data.
6. Availability and changes
We work to keep the Service reliable but do not guarantee uninterrupted availability, and no service-level agreement applies unless we agree one in writing. Support is by email at isekaagency@gmail.com; we aim to respond promptly but do not guarantee a response time. We may change or withdraw features with reasonable notice where the change is material. Apple Wallet pass updates depend on Apple's systems and are not guaranteed to be immediate.
7. Intellectual property
We own the Service and its software. You own your branding, logos and programme content, and grant us the licence needed to display and deliver them as part of the Service. Customers' data belongs to the parties as set out in the Privacy Policy and DPA.
8. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Subject to that, we are not liable for indirect or consequential loss (including lost profits), and our total liability in any 12-month period is capped at the fees you paid us in that period. As the provider is a sole trader, "we" means the individual trading as Iseka Loyalty personally.
9. Termination
You can stop using the Service at any time by cancelling your subscription. We may suspend or terminate access for material breach, unlawful use or non-payment, with notice where practicable. On termination, you may request an export or deletion of your customer data. The proposed retention policy is deletion or anonymisation of Merchant customer data within 12 months of the subscription ending, unless you ask sooner or the law requires longer retention. [TO CONFIRM — end-of-subscription deletion process and timetable have not been operationally verified; this is a draft policy, not a verified deletion guarantee]
10. General
Once approved and accepted, these terms, together with the Privacy Policy and DPA, are intended to be the whole agreement between us. These drafts are not yet binding. If a part is found unenforceable, the rest remains in force. These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction.
